Does HSR training expire in NSW, ACT or Comcare?

✅ No. HSR training in NSW, ACT and Comcare workplaces does not expire. Once you complete the approved 5-day course, the certificate remains valid with no legal renewal required. HSRs are entitled to annual 1-day refresher training, which is recommended but not mandatory.

HSR Training ACT & Canberra: No, It Doesn’t Expire

If you’ve completed the initial 5-day HSR training in Canberra or the ACT, you might be surprised to learn:


There is no legal expiry date on HSR training in the ACT
.

Once you complete the approved training, your certificate stays valid,  even if your three-year elected term ends. If your work group re-elects you, you don’t need to re-do the training.

You are entitled to request a 1-day HSR refresher training each year, however it’s not mandatory.

Where does the “3-year expiry” myth come from?

  • Some states (like Queensland) used to require refresher training every 3 years

  • HSRs are elected for 3 years, which gets confused with training validity

  • Some training providers recommend refreshers every 3 years as a best practice

  • Many safety roles (like first aid) do expire after 3 years, so people assume HSRs do too

But in the ACT, there is no expiry.

HSR Training NSW: Same Foundation, Same Misconceptions

If you’re in NSW, the situation is very similar.

According to SafeWork NSW  
“Neither the Initial 5-day nor 1-day Refresher course certificates have an expiry.”

What About Comcare HSR Training?

For those working under Comcare (Commonwealth-regulated workplaces), the rules follow the model WHS legislation.

  • HSRs have a 3-year term of office

  • You’re entitled to the initial HSR training and refresher training annually

  • No expiry on the training certificate itself

If you’re re-elected or continuing in your role, you don’t need to retrain unless you want to update your knowledge.

Common Misconceptions About HSR Training Expiry

Despite clear guidance from WorkSafe ACT, SafeWork NSW, and Comcare, many HSRs still believe their training expires. Here are six extra reasons this myth sticks around:

1. “Expiry Reminders” from HR Systems

Some internal training systems automatically flag all certifications as expiring after 3 years, even if not legally required. It’s a software default, not a legal rule.

2. Consultants or Auditors Recommending Best Practice

WHS consultants or auditors sometimes suggest a 3-year refresher cycle. While it’s good advice, it’s not a legal requirement and should be explained as optional.

3. Enterprise Agreements or Union Docs

Some EAs or union materials include refresher training schedules. These are sometimes based on industry best practice, not ACT,  NSW or Comcare legislation.

4. Assumptions from Other Safety Roles

Many workplace roles  like first aiders or fire wardens do have a 3-year refresher requirement. It’s easy to assume HSRs fall under the same rule (but they don’t).

5. Confusion Between HSRs and WHS Committee Members

The training expectations for WHS committee members can vary by company. HSRs often get lumped in with them, even though their legal entitlements are different.

6. Old Certificates With “Review By” Dates

Some older HSR training certificates included a “recommended by” date,  often set 3 years ahead. This was never a legal expiry, but the wording caused confusion.

The Bottom Line
There is no expiry date for HSR training in ACT, NSW, or under Comcare. But regular refreshers are still the best way to stay sharp, confident, and compliant.

Should I Do a HSR Refresher Training?

It’s not compulsory, but it’s highly recommended. A 1-day HSR refresher training helps you:

  • Stay across new WHS laws and practices

  • Feel more confident using your powers

  • Maintain credibility with management and your work group

  • Better identify hazards and raise concerns

  • Avoid being caught out by outdated knowledge

You’ve got the legal right to request it and your PCBU must make it happen within 3 months.
